A registered design is protected for a maximum period of 25 years. How can design protection be made eternal? The requirements for a design are novelty and individual character which show that the connection is all within the design and its comparison with any others. The design that is to be transformed into a trademark, on the other hand, must have a decisive characteristic, namely distinctiveness. If the three-dimensional trademark is capable of being distinctive then it will have that requisite valid for its registration, thus placing it in a dimension of eternal duration, however subject to the possibility of revocation and invalidity .
